The document that follows this blurb is the agreement you enter into us when using our site. Why do we need such a thing? Well, to be perfectly honest, our lawyers have told us that we need to protect ourselves. We at medicaldevicestar.com pride ourselves on our low-key style, but the nature of this business means that one lawsuit from one user in a far-flung jurisdiction could put us out of business. It also means that, without this agreement, we might not have protection from people who misuse our software.

Let us know. Tell us what you find unacceptable about our agreement. We can’t promise to change anything, but we will do our best to get back to you.

Introduction

User agrees to the terms and conditions outlined in this online agreement with respect to the services and information provided by or through the site. This agreement constitutes the entire and only agreement between medicaldevicestar.com and the user, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the services and information provided by or through the site, and the subject matter of this agreement. The user agrees to review this agreement prior to usage. Registration shall be deemed acceptance of this agreement.

Editing, Deleting, and Modification

Medicaldevicestar.com reserves the right in its sole discretion to edit or delete any improper information or content appearing on the site. Upon notice published over the service, medicaldevicestar.com may modify this agreement, or prices, and may discontinue or revise any or all aspects of the site in its sole discretion and without prior notice. Modification of this agreement shall be deemed effective upon publication on the site.

Right to Refuse

Medicaldevicestar.com reserves the right in its sole discretion to refuse service to anyone at any time.

Indemnification

User agrees to indemnify, defend and hold medicaldevicestar.com and its affiliates, licensers and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to a user’s violation of this agreement or use of the site.

Cancellation

User may cancel service any time via written (email is acceptable) notice to medicaldevicestar.com. Upon receipt of cancellation, user shall be released from this agreement. It is the user’s sole responsibility, if user so chooses, to cancel the service as aforementioned.

Customer Account, Password, and Security

User is responsible for maintaining the confidentiality of password and account, and is fully responsible for all activities that occur under user’s account. User agrees to (a) immediately notify medicaldevicestar.com of any unauthorized use of password or account or any other breach of security, and (b) ensure that you user exits (via logout) account at the end of each session. Medicaldevicestar.com shall not be liable for any loss or damage arising from user’s failure to comply with this section.

Disclaimer

The service, content, and services from or through the service are provided “as-is,” “as available,” and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose). The sole and entire maximum liability of medicaldevicestar.com, for any reason, and user’s sole and exclusive remedy for any cause whatsoever, shall be limited to the amount paid by the customer for the particular items purchased. medicaldevicestar.com and any of its affiliates, dealers or suppliers are not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of agreement, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. The limitations of damages set forth above are fundamental elements of the basis of the bargain between medicaldevicestar.com and user. This site and services would not be provided without such limitations. Some state statutes may apply regarding limitation of liability. Medicaldevicestar.com retains the right to halt services if this agreement is breeched.
